The fact that a minor has lived or played football in another country should not become an obstacle when their family returns to or moves to Spain. Yet, season after season, we continue to see parents who, after enrolling their children with a football club, discover that obtaining what should be a straightforward registration can turn into a far more complex process than they ever expected.<\/p>\n\n\n\n
International transfers, FIFA, TMS, Article 19 of the FIFA Regulations on the Status and Transfer of Players (RSTP), exceptions and international clearances are concepts entirely unfamiliar to most families, whose only intention is for their child to be able to play football. In some cases, however, the outcome is always the same: the Royal Spanish Football Federation (RFEF) does not issue the player\u2019s licence and the minor is left unable to compete.<\/p>\n\n\n\n
This week, at Himnus Football Lawyers, we received two new favourable decisions from the Spanish Sports Council (Consejo Superior de Deportes, CSD) in proceedings of this kind. Two different families, two minors affected and, once again, the same conclusion: a refusal to process or issue a football licence does not necessarily mean the end of the road.<\/p>\n\n\n\n
The real news is not so much what the CSD has said. What is truly significant is that it still needs to be said.<\/p>\n\n\n\n
Both cases arise from situations that are becoming all too familiar. They concern Spanish minors who had previously been involved in football abroad and who, when seeking registration to compete in Spain, encountered the restrictions arising from FIFA\u2019s international regulatory framework governing minor players.<\/p>\n\n\n\n
For any family, the situation can be difficult to understand. The child is Spanish, lives in Spain, holds Spanish identification documents and wants to play for a Spanish club. Yet, because they were previously registered in another country, their registration becomes subject to an international federation procedure that may ultimately make their ability to compete dependent on FIFA\u2019s authorisation.<\/p>\n\n\n\n
When that authorisation is not granted, or the international registration is rejected, the practical consequence is simple: the child cannot play.<\/p>\n\n\n\n
Faced with those situations, the families lodged the corresponding appeals before the Spanish Sports Council with the assistance of Himnus Football Lawyers. In both cases, the outcome was once again favourable: the CSD upheld the appeals and recognised the minors\u2019 right to obtain their football licences.<\/p>\n\n\n\n
We have previously examined how the Spanish Sports Council has rejected the automatic application of Article 19 of the RSTP where it results in additional requirements being imposed on Spanish minors simply because they previously lived or played football in another country. We have also seen how the CSD has extended that protection to foreign minors who are legally resident in Spain, stressing that Spanish law protects their access to sport and that lawful residence is a key factor when obtaining a licence to participate in non-professional competitions.<\/p>\n\n\n\n
We have even analysed a more complex scenario: cases in which the RFEF does not issue a formal decision at all, but simply stops processing the application. In those circumstances, the CSD has also recognised that certain federation measures may be challenged when they effectively prevent the player from obtaining a licence.<\/p>\n\n\n\n
These two new decisions therefore do not amount to a legal revolution. And that is precisely why they matter. When different cases, involving different families and different factual circumstances, repeatedly end with the Spanish Sports Council upholding the appeals, it becomes increasingly difficult to describe the outcome as an isolated interpretation. What we are seeing is an increasingly consistent administrative approach.<\/p>\n\n\n\n
Why, then, are families still facing these problems?<\/p>\n\n\n\n
This is probably the most important question because, from a family\u2019s perspective, the problem begins long before any legal debate arises.<\/p>\n\n\n\n
Parents return to Spain or move here with their children. The child starts school, joins a football club and trains with their teammates. Everything appears normal until the time comes to process the player\u2019s licence. That is when the problem arises: the club is informed that FIFA authorisation is required, documents concerning the family\u2019s relocation are requested, one of the exceptions under Article 19 of the RSTP must be demonstrated, and the application moves through different organisations and platforms while the weeks continue to pass.<\/p>\n\n\n\n
In the meantime, the child can train but cannot compete.<\/p>\n\n\n\n
When a negative response eventually arrives, many families assume there is no alternative. Some are even told that the player will have to wait until turning 18 before being able to play.<\/p>\n\n\n\n
However, our experience in these proceedings shows that a FIFA rejection, a communication from the RFEF or even the closure of a file should not automatically be treated as a final decision without first examining the circumstances of the individual case.<\/p>\n\n\n\n
What should you do if the RFEF does not process a minor\u2019s football licence?<\/p>\n\n\n\n
No two cases are exactly the same. The player\u2019s nationality, their residence status in Spain, the circumstances surrounding the family\u2019s relocation, their previous registration with another football association, the specific action taken by the RFEF and the procedural stage of the case can all substantially affect the appropriate legal strategy.<\/p>\n\n\n\n
For that reason, the first step should not be to submit documents indiscriminately or to file repeated applications with FIFA. The priority should be to identify what is actually preventing the licence from being issued.<\/p>\n\n\n\n
In some cases, there is an express decision. In others, FIFA has previously rejected the international transfer or registration. And in certain situations, there is not even a formal refusal: the RFEF has simply decided not to continue processing the application. The distinction matters because it may also determine the appropriate route of appeal.<\/p>\n\n\n\n
What these new decisions once again demonstrate is that the international football regulatory framework cannot be considered in isolation. The issue of a licence allowing a player to compete in Spain is also subject to Spanish law and to the corresponding administrative review mechanisms.<\/p>\n\n\n\n
An important distinction must nevertheless be made. The case of a Spanish minor returning to Spain after living abroad is not identical to that of a foreign minor whose family lawfully relocates to Spain. The legal arguments may be different.<\/p>\n\n\n\n
In the case of Spanish minors, the CSD has placed particular emphasis on the fact that they cannot be placed in a less favourable position simply because they previously lived outside Spain. In the case of foreign minors, the key element is generally their lawful residence in the country.<\/p>\n\n\n\n
Despite those differences, both situations ultimately create a very similar practical problem: minors who are fully integrated into life in Spain are unable to participate in competitions because their licence has become subject to an international procedure that may take months to resolve. For the families involved, the consequence is exactly the same: their child cannot play.<\/p>\n\n\n\n
At Himnus Football Lawyers, we have been advising families for years in matters involving football licences for minors and international transfers. During that time, we have acted in cases involving Spanish minors returning from abroad, foreign minors legally resident in Spain, and proceedings in which the federation process itself became blocked without any formal decision being issued.<\/p>\n\n\n\n
This does not mean that every refusal can be successfully challenged, nor that all cases are identical. Each situation requires a careful review of the documents, the procedural history and the decisions adopted throughout the process. There is, however, one conclusion that families should be aware of: the fact that the RFEF or FIFA has initially prevented a minor\u2019s registration does not necessarily mean that the player must remain unable to compete until turning 18.<\/p>\n\n\n\n
Before accepting that outcome, it is worth establishing exactly what has happened and whether there is a legal route through which the decision can be reviewed.
